In Virginia, “simple” possession of a controlled substance is the offense the state often charges people with when they are found with an illicit substance in their possession, but there is no evidence they intended to sell it or were responsible for manufacturing it. Possession of a Schedule IV drug, a Class 2 misdemeanor, comes with a penalty of up to six months in prison and a $1,000 fine. Possession of Schedule V and VI drugs, charged respectfully as Class 3 and 4 misdemeanors, merely result in fines.
